Landmark Judgement ..! All women have the right to safe Abortion..!?

The supreme court has ruled that all women have the right to safe, legal abortion and that the distinction between married and unmarried women is 'unconstitutional'. The supreme court on thursday ruled that all women have the right to safe, legal abortion and that the distinction between married and unmarried women is 'unconstitutional'. The supreme court has held that a woman's marital status cannot be used as a reason to deprive her of her right to terminate an unwanted pregnancy. Single or unmarried women also have the right to an abortion up to 24 weeks under the Medical Fertility Act and Regulations, it added.
The supreme court has said this while the case regarding regulating the regulation on whom abortion should be performed and under which circumstances came up for hearing in the supreme court today. The court further said that the differences between married or unmarried women under the Contraception Act, including rape etc., is constitutionally unsustainable and artificial.
These judgments come as the supreme court is set to announce its verdict today on whether an unmarried woman can abort a fetus between 20-24 weeks. Justice DY Chandrachud said the interpretation of the MTP Act on abortion should reflect the social reality. Social norms change and evolve as society changes. Therefore, it cannot continue without a change in the law, he said. The supreme court held that unsafe abortions are preventable and must take into account the mental health and condition of the pregnant woman.

Married women may also be part of survivors of sexual assault or rape. A woman can become pregnant due to her husband's non-consensual act. Justice Chandrachud said that gender and gender-based violence also exist in families. Ultimately it is up to each woman to make a decision based on her circumstances. Various economic, cultural, or social factors play an important role in this. The judge said the artificial distinction between married and unmarried women could not be sustained. It is the woman who carries the fetus. Therefore, it is up to the woman to decide whether she wants the embryo or not. Denial of this right is an affront to her dignity, said Justice Chandrachud.
