Based on a plea filed by Rakhi Sawant's counsel Falguri Brahmabhatt, the bombay high court has issued a notice to actress Sherlyn Chopra. The suit seeks to have a FIR filed against Brahmabhatt dismissed. The panel of Justices PD Naik and NR Borkar issued a notice to Chopra while also exempting Brahmabhatt from appearing in the trial court.
In november 2022, Chopra filed a FIR against actor Rakhi Sawant, alleging that Sawant had shown an unpleasant video of Chopra at a press conference and used insulting language. Brahmabhatt was defending Sawant at the time, and the actor was granted anticipatory relief by the bombay High Court. The videos were also taken off from many internet portals.
Brahmabhatt's lawyer, sameer Vaidya, contended that despite not being named in the original FIR, Brahmabhatt became implicated in the case when the Amboli police summoned her for a statement. Brahmabhatt was suddenly named as one of the defendants when the police issued the chargesheet. Vaidya stated that this lawsuit was launched against the advocate with ulterior motivations and malafide intentions since Brahmabhatt has been defending Sawant and simply to hinder her from performing her professional obligations.
Vaidya further criticised the use of sexual harassment charges under the indian Penal Code and certain parts of the Information technology Act to a lawyer who was only carrying out her duty. The high court has set a hearing for december 10 to hear arguments from all parties involved: Brahmabhatt, the Amboli police investigators, and Sherlyn Chopra.
