MUDA Case: Will Siddaramaiah resign from the post of CM?After not getting relief from the single bench of Karnataka High court on tuesday (24 september 2024), chief minister Siddaramaiah can now appeal before the double bench tomorrow i.e. wednesday (25 september 2024). If sources related to Siddaramaiah are to be believed, the cm is preparing for this. In fact, he contested the legality of the Governor's clearance for a probe against him in the mysore Urban Development Authority (MUDA) site allocation matter, and on Tuesday, the karnataka High Court's single bench denied his appeal. The governor may permit the case to be lodged based on a personal complaint, the court ruled.Will not resign till the supreme Court's decision comesOn appealing to the double bench on behalf of the cm, an appeal can be made to stay the hearing in the lower court till the hearing of this petition is completed. If the double bench accepts the petition for hearing, then Siddaramaiah will get relief. The cm camp has made it clear that if relief is not given even by the double bench, then the supreme court will be approached and till then Siddaramaiah is not in a mood to resign.Siddaramaiah had said in his petitionSiddaramaiah had challenged the order issued by the governor on august 17, which allowed investigation under Section 17A of the Prevention of Corruption Act and sanction for prosecution as per Section 218 of the indian Civil Security Code (BNSS). Crimes relating to suggestions or choices made by public servants while performing their official tasks are investigated under Section 17A.The Chief Minister's petition claimed that the sanction order was issued without proper deliberation, which violates legal requirements and is contrary to constitutional principles, including the advice of the Council of Ministers under Article 163 of the Constitution, which is binding.It also said that the impugned order of approval is malicious and is part of an organised effort to destabilise the elected government of karnataka for political reasons.
