Karnataka HC Stays Probe Against Nirmala Sitharaman in Electoral Bonds Case
The karnataka High court has temporarily halted the investigation against Union Finance minister nirmala sitharaman and several others related to alleged irregularities in the now-defunct electoral bond scheme. Justice M Nagaprasanna issued the interim order following a petition from bjp leader Nalin Kumar Kateel, who challenged the FIR naming him as an accused. The case will be reviewed again on october 22.
Background of the Case
The FIR was registered under various sections of the Bharatiya Nyaya Sanhita, including 384 (extortion), 120B (criminal conspiracy), and 34 (common intention), on the directive of a special court. Alongside Sitharaman, Enforcement Directorate officials and several bjp office-bearers, including karnataka bjp chief B Y Vijayendra, were also named.
Allegations
The complaint was filed by adarsh R Iyer, Co-President of the Janaadhikaara Sangharsha Parishath (JSP). Iyer alleged that the accused were involved in an extortion scheme under the guise of electoral bonds, claiming that they benefitted by over ₹8,000 crore. The complaint suggested that Sitharaman and ED officials facilitated this alleged extortion for the benefit of various individuals and organizations, asserting a coordinated effort between the bjp officials and the ED.
Supreme court Ruling
The electoral bond scheme was struck down by the supreme court in February, which ruled that it infringed upon the right to information and freedom of speech as guaranteed by the Constitution. This legal backdrop adds complexity to the ongoing allegations and the current stay on the investigation.
