No detail in chargesheet on how entities were bribed - Adani Case
Former Attorney General and senior counsel mukul rohatgi stated on wednesday that the indictment presented by US prosecutors in a bribery case does not accuse gautam adani and his nephew with violating the US Foreign Corrupt Practices Act (FCPA). While the allegations state that Adanis bribed indian organizations for solar power contracts, Rohatgi told the reporters that they do not specify how the bribery was carried out.
"There are 5 counts or charges in this indictment. But count 1 and count 5 are more important than others. gautam adani and his nephew have not been charged with FCPA (count 1), which is like India's Prevention of Corruption Act. They have also not been charged with obstruction of justice (count 5). Some foreign people are named," Rohatgi said. According to the senior attorney, the Adanis has been implicated in two or three further securities and bond-related charges.
In its official statement, AGEL addressed the claims made in certain media articles.
"Mr. gautam adani, Mr. Sagar adani and Mr. Vneet Jaain have not been charged with any violation of the FCPA in the counts set forth in the indictment of the US DOJ or civil complaint of the US SEC. These directors have been charged on three counts in the criminal indictment namely (i) alleged securities fraud conspiracy, (ii) alleged wire fraud conspiracy, and (iii) alleged securities fraud," said the statement from adani Green Energy Limited.
"Mr. gautam adani, Mr. Sagar adani and Mr. Vneet Jaain have not been charged with any violation of the FCPA in the counts set forth in the indictment of the US DOJ or civil complaint of the US SEC.
