Does Rahul Gandhi have UK passport? Does India allow Dual Citizenship?

SIBY JEYYA
The purported dual citizenship of congress leader rahul gandhi has become a major political problem. The allahabad High Court's lucknow bench has ordered the Center to furnish information on the steps taken in response to a case that casts doubt on rahul Gandhi's indian citizenship.

The administration responded to the court's inquiry by saying that an investigation is underway. "The Ministry of home Affairs (MHA) has received the petitioner's representation," the deputy attorney general of india told the court.

The next hearing was set for december 19 by the court, and the extra solicitor general was directed to get the required material from the Center and provide it on that day.

Who is the petitioner? What is the entire controversy?

S Vignesh Shishir, a karnataka bjp employee, is the petitioner in this case. He filed a public interest lawsuit (PIL) at the allahabad High Court. Notably, his PIL claims that rahul gandhi is a dual citizen, which, if confirmed, would be against indian law and disqualify him from running for office or serving in the Lok Sabha.

Given that dual citizenship is illegal under the Passport Act and the Bharatiya Nyaya Sanhita, the petition asks the Central Bureau of Investigation (CBI) to open an investigation and file a complaint.

According to The Hindu, Vignesh also asked the court to order Gandhi's election certificate to be revoked by the Chief election Commissioner, the Chief election Officer of Uttar Pradesh, and the Returning Officer of Raebareli.

Following the dismissal of an earlier plea, in which the court instructed Shishir to contact the appropriate authorities in accordance with Section 9(2) of the Citizenship Act, 1955, as permitted by law, this petition was submitted.

The petitioner's representation is being considered, the Union home Ministry told the court in the interim. According to the ministry's response, "The petitioner's representation has been received by the Ministry and is now being processed. List this issue for december 19, 2024. The court will be informed of the representation's conclusion on the next listing date.

"I am hoping that the government will promptly revoke rahul Gandhi's indian citizenship," Shishir told NDTV. The UK government has informed us directly that Mr. Gandhi's name appears in their citizenship records.

"We have presented all the documents to the allahabad High court," he said to the media site. Dual citizenship is prohibited by indian law. indian citizenship is immediately revoked whenever a person obtains citizenship in another country.

Another case in delhi HC regarding Rahul's citizenship?

Based on a request made earlier this month by bjp leader Subramanian Swamy, the delhi High court was considering a different issue about rahul Gandhi's citizenship.

Swamy requested that the Ministry of home Affairs take action in response to his plea that Gandhi's indian citizenship be revoked.

What is dual citizenship?

As a result, they are able to hold passports from both nations, make use of the same legal and social rights as other citizens, take part in both countries' political processes, travel without a visa, and work in either nation.

The United States, Finland, Albania, Israel, and pakistan are among the countries that permit dual citizenship. However, the guidelines and policies about this status vary widely across countries.
