In order to understand this subject in detail, we first need to know what it means to be a fugitive.


Section 82 of the criminal Procedure Code, CrPC, provides for declaring a fugitive.

Once a case is registered with the police, they take action. An investigating officer is appointed. The police are investigating the possible accused and witnesses in connection with that investigation.

The police want the accused to be present for the interrogation.

For that,

  • They are summoned by the court.

  • If the accused is not present even after issuing the summons, a warrant is issued in his name.

  • There are two types of warrants. One warrant is bailable, the other is non-bailable.

  • First, a bailable warrant is issued against the accused. For this, inspection is done by going to the address of the accused. Attempts are being made to deliver this warrant to him.

  • However, if the accused is not found, it is ordered to arrest him. A non-bailable warrant is then issued in his name.

  • The accused is given a specific term after a non-bailable warrant. If the accused is not found even after that, then the government party demands the court to declare the accused absconding.

For this, the application is made to the court in a formal manner. After hearing this, the court examines all the issues and agrees to this demand. The accused is then declared absconding. Now the police Commissioner of mumbai who is missing is declared absconding.
