In addition to a lack of court employees and infrastructure, other factors contributing to the backlog of cases in the nation's courts include non-evidence gathering, and non-cooperation from investigating agencies, witnesses, and interested parties such as litigants. The lack of a deadline set by the relevant courts for the resolution of various case types, the frequent postponement of hearings, the tracking of ongoing cases, and the monitoring of cases for hearing are some of the factors contributing to the delays in case disposal. It also takes a long time without a mechanism to determine the outcome of any case.

The nation's government states that while police, attorneys, investigators, and witnesses all play crucial roles in resolving cases in court, the process of reaching a decision can take some time if these parties put up significant obstacles in their way. 

What is starting to become a problem?

Due to a lack of attorneys, cases are not heard in court at this time. The Law minister states that the judiciary is responsible for resolving issues that are still pending in court. The government is not directly involved in how court decisions are decided."

Recent data from the National Judicial Data Grid study showed that 8,82,000 cases have seen the parties and litigants cease appearing in court, and there are 61,57,268 cases nationwide that still have pending cases in which attorneys are not showing up. The report states that there are 66,58,131 cases where neither the accused nor the witnesses show up. This also prevents the case from being heard. In excess of 36 lakh cases have occurred in which the accused has fled after being granted bail.
