"The Center is misusing the powers under Article 293. Although this has been going on for a long time, the situation has deteriorated rapidly in the last few years and a clear consensus has emerged among progressive state governments that such indirect control over state funds should be removed.



"As you have rightly pointed out, public borrowing for financing the public expenditure of the states is within the exclusive purview of the state legislatures under the Constitution of India," the chief minister said in his letter. However, the Center misuses its powers under Article 293 of the Constitution to restrict the borrowing space of the States.


In the case of tamil Nadu, such measures have had a significant impact on fundraising for government initiatives. For example, in 2023-24, the central government has pegged the GSDP growth to calculate the net borrowing ceiling at just 8 per cent, despite the state consistently achieving 15 per cent nominal growth in the last two years.


This has resulted in a loss of ₹6,000 crore in borrowings in the current year. A mandatory condition to fund total losses of state discoms under the guidelines for additional borrowing for power sector reforms has forced tamil Nadu to pay ₹17,111 crore to TANGEDCO in the current year. This is likely to affect the state in the future as well, he said.
